Terms and Conditions
1.1. These Terms and Conditions constitute a legal agreement between you and us, governing the use of our e-commerce service for the Services.
1.2. We reserve the right to modify, update, or replace these Terms and Conditions at any time, in respect of future orders, without liability to you and without prior notice. If we revise these Terms and Conditions, we will publish the revised version on the Website. Any changes will be effective immediately upon posting on our Website. By using the Service or Website or placing orders after we have changed these Terms and Conditions, you will be accepting the changes.
1.3. Our Service is only available to individuals who are:
i) at least 18 years old;
ii) residents in, and accessing the Service via the Website from, New Zealand; and
iii) capable of entering into legally binding agreements. By using our Service, you represent and warrant that you meet these eligibility requirements.
The Service may be used to purchase foreign currency cash for holiday or business travel only and not for speculative, investment or any other purposes.
1.4. We may, in our sole discretion, refuse to provide the Service to any person for any reason. We are not liable for any cost, loss or damage incurred by you if we refuse to provide the Service to you.
2.1. Our e-commerce platform enables you to purchase foreign currencies as foreign currency cash.
2.2. The exchange rates displayed on our Website are indicative and subject to change. The final exchange rate will be determined at the time of the transaction and may differ from the displayed exchange rate. The exchange rate applicable to your transaction is the rate set out in your order confirmation.
2.3. We use reasonable efforts to ensure the accuracy of the information provided on our Website. However, we do not warrant or guarantee the accuracy, completeness, or reliability of any information, including exchange rates, displayed on our Website.
3.1. To place an order through our Website, you must follow the instructions on the ordering pages of our Website. You will be able to correct errors on your order up to the point at which you click on the "Purchase Currency" button on the “Payment” page. Once you have entered the ordering process you must complete your order before your session times out otherwise you will need to restart the order process.
3.2. You must provide accurate and complete information, including the type and amount of foreign currency cash required, payment method, and collection store preferences.
3.3. When selecting the amount of foreign currency cash required, the Website calculator will round up to the closest denomination (variable depending on foreign currency) adjusting the NZD value to the new foreign currency amount.
3.4. By submitting an order, you make an offer to purchase foreign currency at the specified rate and agree to pay the total amount due, including any applicable fees and charges. We will communicate our acceptance of your offer by providing confirmed order details or by sending you an email confirming the order. Acceptance of your order is conditional on receipt of payment and certain checks required by law.
3.5. The Service is only available for the foreign currencies listed from time to time on ordering pages of the Website. The availability of foreign currency cash is subject to change from time to time at TMNZ's sole discretion.
3.6. You may not select your preferred foreign currency denominations on the Website.
4.1. We will accept payment by New Zealand bank debit card or credit card (Visa or Mastercard).
4.2. For orders placed on the Website, your debit or credit card will be debited with the relevant amount once you press “Purchase Currency" button on the “Payment” webpage.
4.3. You must ensure that your account has sufficient funds available to cover your order and any applicable fees. Third party credit or debit card payments are not permitted.
4.4. Orders cannot be paid for by prepaid cards, VCARD or VIRTUALMC (or any other virtual card or virtual card number).
4.5. Payment via credit card will incur a non-refundable card surcharge (merchant fees) of 1.2% of the total transaction value.
4.6. All prices and fees displayed on our website are in the local currency (NZD) and include any applicable taxes (if any), unless stated otherwise.
4.7. Before submitting payment, you must confirm that you have read and agreed to our Privacy Policy and Terms of Use.
4.8. On the Website, after you click on the “Purchase Currency” button on the “Payment” webpage, the Website will display a confirmation page setting out the details of your order. You will be able to print or download the order confirmation.
5.1. The title to any foreign currency cash that you have purchased will transfer to you immediately upon provision by us of the order confirmation.
5.2. You authorise and accept that TMNZ will hold any foreign currency cash you have ordered as bailee until you collect your order.
6.1. The risk and responsibility for receiving or collecting your order before you depart on your travels rests with you. Please remember to allow sufficient time to make your collection before departing on your travels.
6.2. When you place your order for the purchase of foreign currency cash via the Website, you must select a TMNZ store where you wish to collect the order (“Collection Location”). You cannot change the Collection Location after the order has been submitted.
6.3. You will be notified via email when your order is ready for collection; orders cannot be collected before this email is sent. Orders must be collected within 14 days of receiving the ‘ready for collection’ confirmation email. Failure to collect the foreign currency cash within the given timeframe may result in cancellation of the order.
6.4. Orders must be collected by the person who made the order from the Collection Location nominated in accordance with paragraph 6.2, during TMNZ store opening hours. Please check online for opening hours and allow sufficient time to make your collection before departing on your travels.
6.5. We reserve the right to change the Collection Location and/or collection time by notifying you prior to the collection date if we are unable to fulfill your order from your nominated Collection Location.
6.6. At the time of collection, you must produce the following:
i. a copy of your online order confirmation or your order reference number; and
ii. a form of government issued photo identification which must be in original, physical form.
6.7. For the avoidance of doubt, if you do not present your identification and other items for verification at the time of collecting your order, you will not be able to collect your order and your order may be cancelled by us.
6.8. In order to comply with anti-money laundering and other legal obligations and our internal risk and fraud policies, you may be requested to provide further information and identification documents (such as proof of residential address) and we may take a copy of your identification documents and other documents at the time of collection. These requirements are in place to enable us to comply with laws and regulatory requirements and to help to protect you against fraud.
7.1. To purchase foreign currency cash, you must provide certain information to allow us to process your order. We reserve the right to request further information from you at any time to enable us to complete your order and / or to comply with regulatory or third-party requirements, in particular but not limited to the Anti-Money Laundering and Counter Financing of Terrorism Act 2009 (NZ) (AML/CFT) and related regulations and codes of practice. We will use various procedures to authenticate each transaction, including those outlined below. We may refuse to provide the Service or cancel the Service if you fail to provide requested or satisfactory information. By placing an order, you confirm that the details contained in the order and all information that you provide to us, is true and correct in all respects. You must not use the Service in a fraudulent manner.
7.2. We may require two forms of identification. The sources of identification accepted by TMNZ are: current New Zealand Driver’s License, current New Zealand Passport, New Zealand Birth Certificate or New Zealand Citizenship Certificate.
7.3. As part of the ordering process, your information will be collected in accordance with our [https://www.travelmoney.co.nz/legal/privacy-policy] Privacy Policy and otherwise, refer to paragraph 13 of these Terms and Conditions.
7.4. Your information will be used to verify your identity. The verification process will be conducted online by GreenID. By using the Service, you agree to be bound by GreenID’s terms of use and privacy policy, which can be found here https://www.gbgplc.com/apac/legal-and-regulatory/
7.5. By using the Service, you are consenting to us collecting your information and disclosing it to GreenID and its suppliers for purposes that include the carrying out of the verification of your identity. This may involve your personal information being provided to third party identification verifiers as set out in the GreenID terms of use and privacy policy.
7.6. Should you fail the verification of identity processes for any reason, we may in our sole discretion:
(i) refuse the Service;
(ii) cancel the order; or
(iii) take any other action as we deem (acting reasonably) appropriate, including directing you to attend at your nearest TMNZ store. You will be notified of any cancellation, and we reserve our right to withhold the basis for any such cancellation from you.
7.7. We will also perform Politically Exposed Persons (“PEPs”) and sanctions checks.
7.8. The verification of identity and the PEPs/sanctions checks will be undertaken each time you purchase foreign currency cash with us via the Website.
8.1. Once an order is submitted and confirmed, it may not be cancelled or modified except with our prior written consent. You may not reverse, cancel or chargeback payment for an order once you have made payment for your order.
8.2. We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraudulent activity or pricing errors.
8.3. In the event of cancellation or rejection of an order, we will refund the amount paid by you within a reasonable timeframe, using the original payment method.
8.4. Returns of purchased foreign currency cash are generally not accepted, unless required by applicable laws and regulations. Notwithstanding this, you may return to a TMNZ store to sell your foreign currency cash to TMNZ at the applicable buy rate of the day, which may be more or less favourable than the rate at which you originally purchased the foreign currency cash. Any debit or credit card fee, cash advance charges issued by your card issuer, commission (if applicable), or any applicable taxes that you have paid on the original order will not be refunded.
9.1. Should you fail to collect your order from the Collection Location within 14 days after your nominated collection date (including by failing to satisfy our requirements under paragraph 6.6), your order will be marked as ‘Uncollected’. We will use reasonable endeavours to contact you to arrange an alternative collection date. If we are unable to contact you within 90 days of the date that our contract was formed, and you have not collected or proceeded to reverse your transaction (with our express consent) in accordance with these Terms and Conditions then the funds held by us at that time will be treated as unclaimed moneys in accordance with New Zealand unclaimed money laws.
9.2. The provisions of this paragraph do not affect your statutory rights.
10. Sanctions
We must comply with New Zealand sanctions laws, and other applicable sanctions regimes, including those administered by DFAT (Australia) and OFAC (United States), as well as United Nations Security Council sanctions (together, “Applicable Sanctions Laws”) as we are prohibited from dealing with sanctioned individuals, entities and countries. If it appears that you are a sanctioned person or are acting on behalf of a sanctioned person or entity or from a sanctioned country, we may be required to suspend or stop providing the Service to you. We may also be required to freeze any transactions with you and freeze any assets of yours which we hold and take any other steps required by Applicable Sanctions Laws or our risk policies. In addition, TMNZ does not accept identification documents issued by certain jurisdictions due to various local and international sanction regulations affecting those jurisdictions. These processes may cause a substantial delay in providing the Service to you or may prevent us from providing the Service to you.
11.1. You must comply with all applicable laws, regulations, and restrictions regarding the use of our foreign currency exchange services, including but not limited to AML/CFT regulations.
11.2. We reserve the right to request additional information or documentation to verify your identity and comply with legal requirements.
12.1. We will use reasonable care and skill in providing the Service. However, subject to your rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 and otherwise to the fullest extent permitted by law, neither TMNZ nor any of its related bodies corporate, directors or employees accept any liability in contract, tort or otherwise for any of the following:
i) if we are unable to perform any of our obligations to you due to failure of any technical systems or for any other reasons beyond our reasonable control including but not limited to war, terrorism, government action, natural disaster, and industrial dispute and any restriction on trade in our stores due to any pandemic or staff restrictions;
ii) for any damage to your computer equipment or other facilities as a result of using the Website or the Service;
iii) for any monetary limits, currency exchange restrictions, country restrictions or any other restrictions or limits outside of TMNZ’s reasonable control (including but not limited to any prohibitions on bringing foreign currencies into a country);
iv) any losses you may incur resulting from foreign currency rate fluctuations, delays, or errors;
v) force majeure or any other event which is beyond our control, or which is not preventable by reasonable diligence on our part; and
vi) damages, losses, claims or expenses suffered as a result of the act or omission of a third party which is beyond our reasonable control.
12.2. We do not accept any liability for any indirect or Consequential Losses suffered or incurred through your use of the Service however caused. “Consequential Loss” means any loss which is:
i) consequential upon another loss;
ii) loss of income or revenue;
iii) a loss of opportunity or goodwill;
iv) a loss of profits;
v) a loss of savings; or
vi) a loss of data.
12.3. Our maximum liability to you in respect of any claims arising from our Service is limited to refunding the purchase price of your order for the specific transaction giving rise to the claim. The disclaimers and limitations of liability in these Terms and Conditions shall not apply to any damages arising from death or personal injury caused by the negligence of TMNZ or any of its employees or for fraud. If any provisions of these Terms and Conditions including these disclaimers and limitations shall be unlawful or unenforceable then such provisions shall not apply but without affecting the validity and enforceability of the remaining terms. This does not affect your statutory rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
13.1. We are committed to protecting your personal information and agree to handle your personal information in accordance with our Privacy Policy, which is available online or in store.
13.2. By providing personal information to us, you agree that our Privacy Policy will apply to how we handle your personal information, and you consent to us collecting, using and disclosing your personal information as detailed in our Privacy Policy. You agree that all information provided by you is true and correct, that any material information will not be withheld, and you will provide us with any additional information that may be required by us.
13.3. All debit and credit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment your order will not be accepted.
13.4. As outlined elsewhere in these Terms and Conditions, the personal information that we collect within the course of providing the Service to you is for the purpose of fulfilling our obligations under the AML/CFT . The Service cannot be provided without us collecting this information for this purpose.
13.5. We may engage a third party to check your identity or verify your information. You agree that we and that third party can collect and use the information you provide to confirm your identity with appropriate sources.
13.6. Details of your identity will be stored in accordance with our Privacy Policy. Your personal information will also be captured and used in order to facilitate collection of your order, for example, receiver details, and personal identifiers such as signature, an image of you on your identification and the identifying digits of your identification, which will be recorded by us in accordance with our Privacy Policy.
14.1. By using the Service, you warrant that:
i) you are authorised to use the Service and will not in any way be in breach of any of these Terms and Conditions when using the Service;
ii) you are using the Service for personal use only; and
iii) you are not subject to any sanctions nor are you acting on behalf of a sanctioned person or entity or from a sanctioned country. Particularly, you warrant that you are not subject to any economic or financial sanctions administered by the Office of Foreign Assets Control of the United States Treasury Department including any ‘Specially Designated Nationals and Blocked Persons’ as prescribed thereunder (the “US Economic Sanctions”), or any such Applicable Sanctions Laws by any other applicable government authority and you will not engage in, and will not conduct any business activities, with or for the benefit of any persons or entities that are subject to such sanctions, including the US Economic Sanctions.
14.2. Furthermore:
i) you acknowledge and assume all of the risks associated in using the Service; and
ii) you acknowledge and agree that it is your responsibility to use the Service in accordance with these Terms and Conditions.
15.1. All content, trademarks, logos, and intellectual property displayed on our Website are the property of their respective owners and protected by applicable intellectual property laws.
15.2. You may not use, reproduce, modify, or distribute any content from our Website without our prior written consent.
These Terms and Conditions shall be governed by and construed in accordance with the laws of New Zealand. Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of New Zealand. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of New Zealand and waive any right that you may have to object to an action being brought in those courts.
17.1. Access to the Website is provided only in accordance with our Terms of Use (“Website Terms”). Please read the Website Terms (which can be accessed at www.travelmoney.co.nz/legal/terms-of-use) carefully before you start to use the Website. By using the Website, you indicate and warrant that you accept the Website Terms and that you agree to abide by them. If you do not agree to the Website Terms, please refrain from using the Website.
17.2. Our Website may, from time to time, contain links to and from the websites of our group companies, selected partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and accordingly we cannot accept any responsibility or liability for such policies. It is therefore advisable to check these policies before you submit any personal information to these websites. By using the Website and our Services you accept the terms governing the websites of our partners.
When you place an order for foreign currency cash via the Website and we receive your payment for the order and accept your offer to enter into the contract for the related Service, we are entering a contract with you personally. Nothing in these Terms and Conditions will confer any benefit on any third party or any right to enforce these Terms and Conditions, on any third party.
